LINGUADVISOR - GENERAL TERMS AND CONDITIONS OF USE AND CONTRACTING

1. General Information

This document regulates the terms and conditions of use of the web platform Linguadvisor (hereinafter, the "Platform"), owned by Pilar Ricart Paredes, holder of DNI 73099144S, residing in Godella, Spain. Contact email: info@linguadvisor.com.

2. Nature of the Platform and Professional Profiles

Linguadvisor is an online marketplace that connects:

  1. Bilingual or native technical professionals with international experience in specific industries.

  2. Certified tutors, linguists, and translators specialized in language teaching applied to technical, professional, and Vocational Training (VT) fields.

(hereinafter, collectively referred to as "Tutors"), with professionals, candidates preparing for public examinations, workers, and students who wish to acquire or perfect a language adapted to their specific employment sector (hereinafter, "Students").

Linguadvisor acts exclusively as a technological intermediary environment. The Platform does not provide formal or accredited education, does not design official curricula, does not deliver direct teaching services, and does not maintain an employment or labor relationship with the Tutors. The relationship governing the educational service, as well as the delivery of conversation, preparation, or mentoring sessions, is established solely and independently between the Tutor and the Student.

3. Account Registration and Security

To use the booking services, both Students and Tutors must register by creating an account. The user is responsible for maintaining the confidentiality of their credentials and for providing real, accurate, and up-to-date information.

  • Personal and Non-Transferable Nature: User accounts, passwords, and access to the Platform are strictly personal and non-transferable. Group purchasing (group buying), piracy, or credential sharing is strictly prohibited.

  • Simultaneous Connection Control: The Platform utilizes automated technical control systems. Access to the private areas of the Student or Tutor is restricted to a single device and IP address simultaneously. Linguadvisor reserves the right to automatically log out or temporarily block accounts where concurrent massive access from different locations is detected, which shall be considered technical fraud and grounds for expulsion without the right to a refund.

4. Booking, Cancellation, and Payment System

  • Payments: Students shall pay for lessons in advance through the Platform's secure payment gateway (Stripe). The prices displayed on the platform are final.

  • Commissions: The Platform will retain a commission percentage for technical service management before disbursing the corresponding balance to the Tutor, in accordance with the rates accepted by the Tutor upon registration.

  • Student Cancellation Policy: The Student may cancel or reschedule a lesson at no cost, provided it is done at least 24 hours in advance. If the cancellation occurs less than 24 hours prior to the lesson, the full amount will be charged and paid to the Tutor.

  • Tutor No-Show (Planto): If the Tutor fails to appear at the scheduled lesson time (subject to a 10-minute courtesy window), the Student will be entitled to a full refund or to reschedule the lesson at no additional cost. Such a lesson will not be paid to the Tutor, and a visibility penalty may be applied to their profile if this behavior is recurrent.

  • Student Delays: The Tutor will wait for the Student for a maximum of 15 minutes from the scheduled start time. After this time, if the Student has not appeared, the lesson will be deemed "Completed and Unattended." Consequently, the Student will be charged in full, and the Tutor will receive their corresponding payout, with no right to make up the lesson.

  • Time Management for Late Arrivals: If the Student joins the video call late (within the stipulated 15-minute courtesy window), the session will conclude strictly at the originally scheduled end time. Under no circumstances will the lesson duration be extended to compensate for time lost due to the Student's delay, nor will any partial or full refund apply.

5. Prohibition of Service Diversion (Anti-Circumvention Clause)

In order to protect the integrity of the Platform and the technological investment made, Students and Tutors are strictly prohibited from exchanging direct personal contact information (such as telephone numbers, personal emails, bank accounts, or personal messaging profiles) with the purpose of bypassing Linguadvisor’s booking and payment system.

  • Communications: All prior communications and lesson coordination must mandatorily be conducted through the Platform's internal messaging system and tools.

  • Sanctions: Non-compliance with this rule will entitle Linguadvisor to immediately and permanently expel both the Tutor and the Student from the Platform, blocking their accounts and profiles without the right to claim or to receive any outstanding balances.

5.1. Commitment to Exclusive Contracting (Tutor Terms)

The Tutor expressly agrees not to suggest, offer, incentivize, or accept direct payments from Students acquired through Linguadvisor outside of the platform. Any subsequent lesson, package renewal, or educational service derived from an initial contact on this website must mandatorily be billed and managed through Linguadvisor.

6. Disclaimer of Commercial Liability

Linguadvisor is committed to the proper technical maintenance of the website but is not responsible for the content, quality, punctuality, or suitability of the lessons taught by the Tutors, nor for any discrepancies or conflicts that may arise between the parties.

7. Governing Law and Jurisdiction

  • If the Student holds the status of a final Consumer, the courts and tribunals of the Student's domicile shall have jurisdiction.

  • In commercial relations with Tutors (freelancers/businesses) or Legal Entities (contracting Companies), both parties expressly waive any other jurisdiction that may correspond to them and voluntarily submit to the jurisdiction of the Courts and Tribunals of Valencia (Spain).

8. Right of Admission, Continuance, and Code of Conduct

Linguadvisor reserves the right of admission and continuance on the Platform in order to guarantee a professional, safe, and respectful environment for the entire community.

Grounds for Direct Expulsion: Immediate account cancellation will take place, without the right to compensation or refunds, in the following scenarios:

  1. Disrespect, insults, or inappropriate behavior towards Tutors, other Students, or the Linguadvisor support team.

  2. The use of video call sessions for commercial purposes, spam, harassment, or any purpose other than pure mentoring and conversation within the intended industry scope.

  3. The dissemination of images (via screenshots, photos) or recording without express prior written authorization of the materials provided by the Tutors or of the educational sessions conducted.

  4. Violating the intellectual property rights of the Platform or its collaborators.
